What are Grant and Publishing Fees?

Once the EPO Examining Division is satisfied that an EP patent application complies with all the requirements of the European Patent Convention (EPC), the applicant is notified of the intention of the EPO to grant a patent (a Rule 71(3) communication).

This notification includes the version of the patent specification that the EPO intends to grant and its issuance triggers a 4 month period in which to respond by approving the text intended to grant or disapproving the text and requesting further amendments/corrections.  Provided that the applicant is happy with the patent specification, the applicant can approve the patent specification and complete the grant formalities which include the payment of the grant and printing fees, as well as filing a translation of the finally approved claims in French and German.

After a response to the communication under Rule 71(3) approving the text is filed, the EPO will then issue another communication, the “Decision to Grant”. This letter informs the applicant that the EPO will now issue the “Certificate of Grant” and publish details of the grant of the patent in the European Bulletin. The Decision to Grant advises the applicant of the date on which this publication will happen: this is the effective date of grant.
