What is a European Phase Entry (PCT)?
Euro-PCT is a shorthand term for the European Regional Phase entry of an international patent application (PCT) at the European Patent Office (EPO). The deadline for entering the European regional phase from a PCT application (Euro-PCT) is 31 months from the earliest priority date of the PCT application. When entering a Patent Cooperation Treaty (PCT) application into the European Phase (Euro-PCT filing), a number of steps are required to be taken.
To enter the European Regional Phase a form 1200 must be completed. You must provide representative details (must appoint a European Patent Agent), request examination (this is automatically ticked on the form), designate the states (again this is automatically ticked on the form), and pay the associated official fees. The fees which must be paid on filing are the filing, search, examination, designation, and excess page fees. Excess page fees are payable for each page over 35 in the application. Entering European Phase Entry (PCT) on Patent Place
To provide a more streamlined and efficient process to save you time, Patent Place provides an automated service that generates the Form 1200 and associated fees. This is achievable by providing the user with a questionnaire in which you answer questions to populate the required information in the form. Once all the questions are answered, you can click ‘submit’ and the system completes all the hard work for you. You will then be provided with a fully populated Form 1200 with a full breakdown of all the official fees.
Excess Claim Fees
Excess claims fees are also payable for each claim over 15. Although it is routine to amend the claims of a European patent application to reduce or avoid excess claims fees, there is no need to do this on filing. The Applicant can wait until the EPO issues a Communication under Rule 161/162 which sets a 6-month period in which to make claim amendments with the excess claims fees being payable at the end of this period.
